Wick Law Office Wins Appeal Before The EEOC’s Office Of Federal Operations

The Wick Law Office is pleased to announce a recent victory on behalf of one of our federal sector clients before the Equal Employment Opportunity Commission (EEOC). Our client, a federal sector employee, won her case alleging ongoing and egregious sexual harassment by a coworker and that the employing Agency failed to act appropriately when she reported the harassment. An EEOC Administrative Judge awarded her compensatory damages for emotional and physical harm caused by the harassment, restoration of leave she took to escape the harassment, an award of attorneys’ fees and costs, and other relief. The other relief included back pay because she applied for, and received, a lower-graded position to separate herself from the harasser.

Although the Agency did not appeal the finding that it was liable for the harassment or the award of compensatory damages and attorneys’ fees and costs, it did challenge the EEOC Administrative Judge’s decision to award her back pay. On appeal, the EEOC’s Office of Federal Operations rejected the Agency’s appeal. The EEOC ordered the Agency to pay back pay and associated benefits, compensate our client for any increase in tax liability as a result of the back pay award, and payment for attorneys’ fees and costs.
